PREAMBLE :

AMĒÏA PARIS is the seller of the products and services on the site. The merchant site www.ameiaparis.com (hereinafter "the Site") is an e-commerce site accessible via the Internet, open to any user of this network. It is operated by the company AME , a company with a capital of 1000 euros, whose registered office is located at 61 Rue de Lyon, 75012 Paris, registered in the Paris Trade and Companies Register, intra-community VAT number FR37977479161. The Site allows AMĒÏA PARIS to offer its products (hereinafter "the Products") for sale in France and abroad. The Site is reserved for individuals and is prohibited for professionals.

These General Terms and Conditions of Sale (hereinafter "GTC") govern the use of the Site and the services (hereinafter "the Services") that may be offered there, as well as any purchase that may be made on the Site. Any use of the Site implies the Customer's full and complete acceptance of these GTC. This acceptance is necessarily full and complete, any acceptance subject to reservation is considered null and void. In the event of modification of these GTC, the applicable GTC are those in force on the date of use of the Services or the order. These GTC are available in French. ART. N°1: PRODUCTS

The essential characteristics of the Products are presented on the Site in each of the Product sheets. The customer is fully informed that the images, photos and colors of the items offered for sale may not correspond to the actual colors due to the Internet browser of the screen used. The products for sale on the Site are available while stocks last. Promotional codes and gift cards cannot be used for the purchase of gift cards. If one or more items ordered are no longer available, the Customer will be informed by email as soon as possible. The Customer may then cancel the order for the item(s) concerned and be reimbursed, if applicable, the amounts already paid, by credit to the bank account corresponding to the bank card used for payment no later than 30 days.

ART. N°2: PRICES

The prices of the Products sold on the Site are indicated by item and reference and are mentioned in euros. The prices of the products are those indicated on the Site regardless of the place of delivery and are understood to include all French taxes (TTC), excluding shipping costs, which are the responsibility of the Customer (see Art. n°8 for more information on shipping costs). Any local taxes that may apply to the sale are the responsibility of the Customer. Any change in the legal VAT rate applicable will be automatically reflected in the prices of the items, as soon as it comes into force. The applicable prices are the prices displayed on the Site at the time of the order.

ART. N°3: REGISTRATION

When placing an order, the Customer is asked to create an account allowing them to view their pre-entered data and benefit from promotional offers. To do so, the Customer must complete a personal information form with complete honesty and is required to update this information as soon as necessary. The Customer must also choose an email address and password, which will be requested each time they wish to access it. The Customer's personal information is thus protected by a password so that the Customer, and only the Customer, has access to it. AME recommends that the Customer does not disclose it to anyone. The Customer must also log out of their profile and close their browser window at the end of each work session. This will prevent users from accessing their personal information. The Customer is solely responsible for the confidentiality of their password. The Customer will bear the consequences of any fraudulent use of their password. In accordance with the law of January 6, 1978, the Customer has a right of access to personal data concerning him/her, which he/she may exercise in writing to Customer Service at the address contact@ameiaparis.com , without prejudice to the right he/she otherwise has to object for just cause to the processing of this data.

ART. N°4: ORDER - STAGES OF CONCLUSION OF THE SALE

  1. The Customer accesses the site www.ameiaparis.com .
  2. The Customer adds the items to their cart.
  3. The Client completes the account creation form.
  4. The Customer checks the elements of his order, identifies and corrects any errors made during entry by issuing an order summary.
  5. The Customer verifies and expressly accepts the General Conditions of Sale of AMĒÏA PARIS.
  6. The Customer confirms the order, the total price and the all-inclusive price, by clicking on “Pay my order”.
  7. The Customer receives an electronic acknowledgment of receipt detailing the details of their order. The order will only be confirmed after payment has been accepted by the Customer's bank and AMĒÏA PARIS has received the order amount.
  8. The Customer receives electronic confirmation of their order.
  9. The Customer receives their package at the delivery address they indicated when ordering.

The order summary will also be accessible on the Site in the "My Account" section, "My Orders" category. Any order will only be validated after acceptance of payment. After payment, an order confirmation is sent by AMĒÏA PARIS to the Customer, by email to the email address provided by the latter. The Customer accepts that the invoice is considered as proof of the contractual relations between the parties. The Customer will have the option to print the invoice sent with the order confirmation.

ART. NO. 5: RESERVATION OF OWNERSHIP

The Products remain the property of AMĒÏA PARIS until full payment for each order has been received.

ART. NO. 6: PAYMENT TERMS

Payment must be made in one payment. The Customer pays for their order by credit card (Visa, Mastercard, American Express) or via PayPal. Bank transactions made on our e-shop are processed by our banking partner, which offers a strict security system. The website www.ameiaparis.com is subject to a security system to protect as effectively as possible all sensitive data related to the payment methods used on the Site.

In accordance with the provisions of Article L 132-2 of the French Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. Any order placed on the Site implies the guarantee on the part of the Customer that he/she has all the necessary authorizations to use the means of payment made available on the Site. AMĒÏA PARIS reserves the right to suspend or cancel any order if it encounters difficulties in collecting payment.

ART. N°7: ANTI-FRAUD

AMĒÏA PARIS reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding the payment of a previous order. Any resale of products purchased on the Site is strictly prohibited. To combat fraud, AMĒÏA PARIS has implemented a system implementing exclusion lists, which may lead it to:

  1. Request, in order to secure the transaction, certain supporting documents once payment has been made, in the event of an automatic alert triggered by the order information.
  2. Block any order from a Customer account previously the source of fraud.

ART. N°8: DELIVERY

AMĒÏA PARIS is committed to preparing your order within 24 to 72 hours excluding weekends and public holidays and within a maximum of 10 working days during peak periods (Christmas, sales, etc.). Delivery costs are calculated based on the delivery address provided by the customer and vary depending on the geographic area. Shipping costs are automatically free when the order exceeds a certain amount for specific areas.

When placing an order, the Customer must choose the delivery method offered on the Eshop:

  • Colissimo or Chronopost.

In case of absence at the time of delivery, the delivery person will leave the package in the Customer's mailbox or leave a calling card so that the Customer can collect it in the following days from a post office or collection point with proof of identity. Once the package has been dropped off, the Customer will be notified by email or text message. The package will be available for up to 10 days on site. After this period, the package will be returned to AMĒÏA PARIS. Customer Service will then contact the Customer for possible reshipment, the costs of which will be borne by the Customer, or if the Customer does not respond, a refund of the order.

ART. N°9: RETURNS

The legal withdrawal period in accordance with the Consumer Code is 14 clear days, without having to provide reasons or pay penalties. This period runs from the receipt of the Products or the acceptance of the offer for the Services.

AMĒÏA PARIS also offers a 14-day period from the date of receipt of the order to return it and obtain a refund for the products, corresponding to the amount already paid. The withdrawal form is available in your account, under "My orders", "Generate a return" or, for mainland France only, by sending us a withdrawal letter by mail.

ART. NO. 10: LEGAL GUARANTEES

The Products benefit from the guarantees of conformity and hidden defects. Without prejudice to the withdrawal period provided for in Article No. 9, in the event that the delivered items do not conform in nature or quality with the specifications indicated in the delivery note, the Customer must inform Customer Service in writing at the address contact@ameiaparis.com . He will then receive a return label by email, which he will print. The Product must be returned in new condition, in its original packaging and accompanied by the delivery note.

ART. N°11: RESPONSIBILITY OF AMĒÏA PARIS

AMĒÏA PARIS is not responsible if the Site is inaccessible or presents access anomalies or bugs of any kind for any reason whatsoever. It reserves the right to promote a third party on the Site in any way, and is not responsible for third-party sites to which visitors are directed from the Site.

Applicable law and competent jurisdiction

These General Terms and Conditions are subject to French law. Any disputes that may arise regarding their validity, interpretation, and execution are subject to the exclusive jurisdiction of the courts of Paris, unless otherwise provided by mandatory procedural rules.

These general terms and conditions of sale are intended to establish the terms of sale between AMĒÏA PARIS and the client, defining the obligations and rights of the parties. If you require additional revisions or specific modifications, please do not hesitate to ask me.

Intellectual property rights

All Products, as well as the texts, comments, photos, brands, graphics, concept, illustrations and images making up the Site are the exclusive property of the company Ame and are protected by intellectual property rights in France and throughout the world.

Any total or partial reproduction of these elements or of the Site is strictly prohibited.

Applicable law and competent jurisdiction

In the event of translation of the Site and the T&Cs, the French language shall prevail for interpretation.

These General Terms and Conditions are subject to French law. Any disputes that may arise regarding their validity, interpretation, and execution are subject to the exclusive jurisdiction of the courts of Paris, unless otherwise provided by mandatory procedural rules.

If the Customer encounters difficulties when ordering or delivering AMĒÏA PARIS items and considers that the rights granted to him as a consumer have not been respected, he can send his written complaint to the email address contact@ameiaparis.com in order to request an amicable resolution of the dispute directly from Ame.

If the dispute cannot be resolved within the framework of the written complaint previously submitted to Customer Service, the Customer has the right to have recourse free of charge, within one year of this complaint, to a consumer mediator with a view to the amicable resolution of the dispute between him and Ame.
